These Terms and Conditions apply to all contracts between Higrate GmbH (hereinafter "Provider") and the user via the SongLove platform (songlove.ai). Deviating terms of the user are not recognized unless the Provider expressly agrees to them in writing.
SongLove is an AI-based platform for creating personalized songs. The user enters an occasion, genre, mood, and a text prompt. The AI generates a unique song from this input. These constitute digital content within the meaning of § 327(1) BGB that is not delivered on a physical data carrier.
The display of plans on the website does not constitute a binding offer. The user submits a binding offer by selecting a plan and completing the payment process. The contract is concluded upon confirmation of payment by our payment provider Stripe.
The following plans apply: • Starter — €0.79 one-time. The Starter plan includes a 3-day trial period. After the 3 days, the plan automatically converts to a Basic subscription (€19.90/month) unless cancelled beforehand. • Basic — €19.90/month • Pro — €29.90/month • Creator — €49.90/month All prices include statutory VAT. Payment is processed exclusively via our payment provider Stripe. No physical products are shipped — all content is digital and available immediately after creation. Subscriptions are billed monthly in advance and renew automatically for another month unless cancelled before the end of the current billing period.
As a consumer, you generally have a 14-day right of withdrawal pursuant to § 355 BGB. Please note: For digital content not delivered on a physical data carrier, the right of withdrawal expires prematurely if the Provider has begun performing the contract after the consumer has expressly agreed that the Provider may begin performance before the withdrawal period expires, and the consumer has confirmed awareness that consent to begin performance results in loss of the right of withdrawal (§ 356(5) BGB). By clicking "Create now" after payment, you consent to immediate commencement of the service and confirm your awareness of the loss of your right of withdrawal.
Monthly subscriptions (Basic, Pro, Creator) can be cancelled at any time effective at the end of the current billing period. Cancellation is done via email to [email protected]. After cancellation, access remains until the end of the paid period. Previously created songs remain available after cancellation. The Starter plan (€0.79) includes a 3-day trial period. If not cancelled before the end of the 3 days via email to [email protected], the plan automatically converts to a Basic subscription (€19.90/month).
The user receives a simple, perpetual right of use for generated songs for personal, non-commercial purposes. Rights to the submitted text prompt remain with the user. Commercial use of songs (e.g., publication on streaming platforms) is only permitted with the Creator plan.
The Provider is liable without limitation for intent and gross negligence. In cases of slight negligence, the Provider is only liable for breach of essential contractual obligations (cardinal obligations), limited to foreseeable, contract-typical damages. Liability for damages resulting from injury to life, body, or health remains unaffected.
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for disputes with entrepreneurs is the Provider's registered office. For consumers, statutory provisions apply.
